Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

My I-485 was filed in June'2007 in Nebraska service centre since my company is based in Michigan. I live in PA.
I am filing my EAD now but according to the latest instructions for EAD, the filing centre should be decided based on where you live. So for PA, the filing centre listed is Texas.
My question is should I file in Texas based on where I live or in Nebraska where my I-485 case was filed. The USCIS case tracker also says that my case is at Nebraska.

Hi one of my relative has cleared the US citizenship exam. He is waiting for the oath. He want to visit canada after a month. Before the canada visit I think the oath will be done and he will become citizen of US. He can not get the US passport instantly.
My questions:
1. After becoming US Citizen can he visit canada without US passport? If yes what docs he needs to carry with hi?

Hi, Last year, I heard about a new rule that says that H4 time will not be counted against H1 time so basically, if someone is transferring from H4 to H1, the time spent in H4 will be excluded while deciding the duration of H1.
Is this rule true ? I mean, has it become a law now ? Did somebody use this rule to grab the time spent in H4.
Please let me know.

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping with an L1 visa already in his passport, will it affect the visa officer's decision in issuing a H1 visa?
Please chime in if anyone has done this before or has any insight on this matter.

It seems quite a few individuals with older priority dates from 2003 & 2004 are still waiting for a decision on their RiR cases (both state and regional) from Dallas BEC. It has been recently reported that many of these cases have received RFE's from BEC on a variety of issues (they might also have had an RFE at state or regional). I think it would be advantageous for all of us in similar situation if we can anonymously post the type of RFE's we receive and possible ramifactions for the same.
If some one knows of a similar thread elsewhere please provide a link, that way we can avoid duplicates.

I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.

Once you get married and get your License your spouse can file for I-130, I485 concurrently. You can file for EAD and Advance parole also along with this you need affidavit of support I-824
