My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. :confused: I came in US on 15 Oct 2006. The company A who had filed my H1 was not able to arrange a job for me till 5-Dec-06 & they were not paying me as well. So I contacted company B & they arranged a project for me & I started working for them & I am being paid by company B from 11-Dec-06 & company B started my H1 transfer without paystub. Now in this case my H1 transfer will approve or not.

Hello,
I got my I-140 Approved (EB3 - Jan 2004) with Company A. Can i use the approval notice and get my H1B extended for 3 years from a different company ? Please advice as this will help me a lot.

My company is processing my Green card and recently applied my I-140. My wife is applying for residency this year. Most of hospitals are saying that they can sponsor only a J-1 visa. Can you please suggest if this would be a problem for my Green Card processing and/or her visa stamping (Since applying for G.C means that we wants to stay and J-1 means the other way round)?

Am on H4 and applied for H1B in May 2006. Because of emergency, we need to travel out of US; got the approval on Sept 7th and returned to US on Sept 10th. I lost hopes of Change of Status petition approval(as one of my friend's COS petetion is rejected eventhough she didnot leave US during H1 process), but surprisingly when I received my papers today, it is approved with old I-94 number. Thank God.
Now, Can I go ahead and apply for SSN. Can they ask me to go for stamping as the I-94 on the approval notice is different from the current I-94 in the passport?

I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".
I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.
However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?
Urgent response will be greatly appreciated.
